These terms govern the use of the Nivoq app (iPhone and Android) and of the Nivoq Pro subscription. By creating your account or using the app you accept them, so please read them carefully. How we handle your data is explained in the Privacy Policy.
In a nutshell
· When you create your account you get 14 days of Nivoq Pro included, with no card and no charge when they end.
· Nivoq Pro is paid through the App Store or Google Play, at the price set by the store; it renews automatically until you cancel it in the store.
· Nivoq's SOS is not an emergency service and does not replace 112: in an emergency, call 112.
· The information in the app is a guide only: on the mountain, the resort's rules and official information always come first.
01Purpose and acceptance
Nivoq is a guide and navigation app for ski resorts: piste and lift maps, recording of your ski days, features for skiing with your friends and circles, and SOS alerts. It is provided by:
Company name: Naranjo Sosa S.L.
Tax ID (NIF): B24763294
Registered office: Bravo Murillo 294, 3.º Izda., 28020 Madrid (Spain)
Email: soporte@nivoq.app
- These terms are the contract between you and Naranjo Sosa S.L. for using Nivoq. You accept them when you create your account; if you do not agree, do not use the app.
- When you buy Nivoq Pro, the terms of the store you buy it from (App Store or Google Play) also apply. On iPhone, these terms complement Apple's standard licence agreement, which keeps its rules on distribution, licensing and payments.
- We may update these terms, for example when the app or the law changes. We will notify you by email and in the app at least 30 days in advance. If a change is essential (it affects the service, the price, the Nivoq Pro features or your data), we will ask you to accept it expressly. If you do not agree, you can close your account at any time (see 12).
02Account
- You need an account to use Nivoq. You can create one with your email and a password, or sign in with Google or Apple.
- You must be at least 16 years old: when you sign up we ask you to confirm it expressly. If we detect that an account belongs to someone under 16, we will suspend or delete it.
- The details you give us must be true. Your account is personal: do not share it or hand it over to anyone.
- Keep your password safe and write to us at soporte@nivoq.app if you think someone has accessed your account.
03Nivoq Pro
14 days of Pro included when you create your account
- When you create your account you get 14 days of Nivoq Pro included. They start counting when you complete sign-up in the app and are granted only once per account.
- They are not a store free trial: you do not need a card or to subscribe to anything, and when they end you are not charged and they do not turn into a subscription. If you do not subscribe, you keep using Nivoq with the free features.
Price and payment
- Nivoq Pro is a paid subscription that you take out and pay for in the App Store (iPhone) or Google Play (Android). Before you buy, the app shows you the available options, their duration and their price. The price is set by the store for your country.
- Apple and Google charge and invoice you as agents or commission agents, using the payment method of your store account. We do not see your card details.
- If the price goes up, the store will notify you before charging the new amount and, where its rules require it, will ask you to accept it.
Automatic renewal
- The subscription renews automatically at the end of each period, for the same period and at the current price, until you cancel it.
- In the App Store, cancel it at least 24 hours before the end of the current period so that it does not renew. On Google Play, cancel it before the renewal date.
How to cancel
- iPhone: Settings → [your name] → Subscriptions → Nivoq → Cancel Subscription.
- Android: Google Play app → your profile → Payments & subscriptions → Subscriptions → Nivoq → Cancel subscription.
- When you cancel, you keep Nivoq Pro until the end of the period you have already paid for.
- Deleting the app or your Nivoq account does not cancel the subscription: you have to cancel it in the store.
Refunds and withdrawal
Withdrawal and refunds are handled through the procedures of the store you bought from (App Store or Google Play): request them from your purchase history in the store. If you are a consumer, you keep the rights the law gives you.
04Paid features
- With Nivoq Pro (also during the 14 included days) you can: see on the map where your friends are, with their piste or lift, and how long they need to reach a meet-up; calculate routes from one point of the resort to another, including to reach a friend; see the heatmap of your season; download offline maps of every resort; and see your full season summary.
- For free you can: record your ski days and see your statistics; download the offline maps of one resort; view the resorts' official piste maps; share your position with your circle and see who in your circle is skiing; send an SOS and, if a friend sends one, see their position and the route to reach them; and see your season summary with your totals and your best day.
- The app shows you which features are Pro.
- We may improve, change or remove features. If you are subscribed, you keep the conditions you signed up for until the next renewal. If a change materially reduces Nivoq Pro, we will tell you beforehand and you will be able to cancel without penalty.
05SOS
Nivoq's SOS is not an emergency service and does not replace 112. If you or someone else is in danger, call 112.
- What it does: it sends a notification only to the members of your circle (or, if you are on an active trip with at least two other people, only to the members of the trip) with your position at that moment. They only see it live if you were already sharing your location and recording a session.
- What it does not do: Nivoq does not alert the emergency services and does not monitor SOS alerts. Help depends on the people who receive the alert seeing it and acting on it.
- It can fail: it depends on the coverage, GPS, battery and connection of your phone and of your friends' phones, and on our service working. Without a connection the alert is not sent: the app tells you so and offers to call the emergency number.
- Your location may be missing or inaccurate: it is the one your phone's GPS provides at that moment. If it has none, we send the last position you shared with your circle in the previous 20 minutes or, if there is none, a notice that your location is not available.
- It switches off by itself: the SOS stays active until you close it, for a maximum of 150 minutes; after that it switches off by itself, without anyone being notified. When you close it, we let the people who received the alert know that you are fine.
- You accept it before using it: the app shows you this notice and asks you to accept it before you use the SOS.
- Only use it in real situations. A false or prank SOS alarms other people and may lead to the suspension of your account (see 09 and 12).
06Safety on the slopes
- Skiing and moving around the mountain involve risks. You decide where you go and how you ski, and you are responsible for those decisions.
- Follow the resort's rules, signs, piste closures and the instructions of its staff. What the resort says always prevails over what the app shows.
- The information in Nivoq (maps, routes, status of pistes and lifts, weather and estimated times) is a guide only. It does not replace your own judgement or the official information from the resort, the weather services or the avalanche bulletins.
- Point-to-point routes suggest a way based on the data available. Always check that it is open and suitable for your level.
- Do not look at your phone while you ski: stop in a safe place, off the piste, before using the app.
- Nivoq is designed for getting around the pistes of a resort. If you leave them, you do so at your own risk and with the right equipment, training and avalanche information.
07Third-party data
- Part of the information in Nivoq comes from third parties: the resorts (pistes, lifts, their status and their piste maps), weather services and map providers such as Google Maps.
- We try to keep it up to date, but we cannot guarantee that it is accurate, complete or current: a piste may close, a lift may stop or the forecast may change without the app reflecting it in time.
- Offline maps are saved on your phone when you download them and may become out of date. Update them when you have a connection.
- Official piste maps belong to each resort, and maps belong to their providers.
- Some links lead to third-party websites, for example to book accommodation or rent equipment. Those services are not ours and have their own terms.
08User content
- In Nivoq you can publish content: your name and profile photo, snow reports, meet-ups, circle names and photos from your sessions, among others.
- That content remains yours. To provide the service, you give us a non-exclusive, free licence limited to what is needed to provide it: storing it, adapting it technically (for example, resizing a photo) and showing it to the right people for each feature (for example, snow reports are seen by all users). The licence ends when you delete the content or your account, except for backups during their retention period. We will not use your content for promotional purposes without asking for your separate permission.
- Only publish content that is yours or that you have the right to publish, that is true (especially snow reports) and that does not infringe other people's rights; for example, do not publish photos of other people without their permission.
Reports, blocking and complaints
- Point of contact: for any matter about content, including if you are an authority, the contact is soporte@nivoq.app, and you can write to us in Spanish, English or French.
- Content rules: those in this section and the rules of use in section 09.
- Report: from the app you can report content or a user that you believe breaks these rules or the law.
- Block: from the app you can block another user.
- What we do: we review each report and, if there is a breach, we remove or correct the specific content or restrict the account. If a measure affects you, we explain why.
- Complain: if you disagree with a decision of ours about a report, your content or your account, you can complain by writing to soporte@nivoq.app. We will reply within 14 days at most.
09Conduct
When you use Nivoq, you must not:
- use it for anything illegal, or to annoy, harass, threaten or impersonate other people;
- send false SOS alerts or publish snow reports you know are not true;
- follow or locate anyone without their consent, or share other people's position or data without their permission;
- create fake or automated accounts, or use someone else's account;
- copy or extract Nivoq's data or content in bulk (for example, with bots or scripts), or resell it;
- try to access our systems without permission, interfere with how they work or get around the limits of the free version;
- decompile or modify the app, except as far as the law allows you to.
If you break these rules, we may remove content, limit features or suspend or close your account (see 12).
10Intellectual property
- The app, the website, the Nivoq brand, their design, texts and code belong to Naranjo Sosa S.L. or to those who have licensed them to us. Third-party maps, piste maps and data belong to their owners.
- We give you a personal, non-exclusive and non-transferable licence to use the app on your devices, for private and non-commercial use, as long as you comply with these terms. We do not grant you any other right.
11Liability
- We work to make Nivoq work well, but there may be interruptions, errors or maintenance breaks, and the app depends on third-party services (the stores, maps, servers and your mobile connection).
- The third-party information shown in the app (pistes, lifts, weather and navigation) is a guide only: the resort's instructions always prevail (see 06 and 07).
- These terms set no financial cap on our liability, do not exclude liability for wilful misconduct, gross negligence or personal injury, and do not limit your rights as a consumer.
12Closing your account
- You can stop using Nivoq whenever you want. To delete your account, go to Profile → Privacy & data → Delete my account: we will send you an email to confirm it, and the link expires after 24 hours.
- Before that, if you wish, download your data in Profile → Privacy & data → Download my data.
- What we delete and what we keep is explained in the Privacy Policy.
- Deleting your account does not cancel your Nivoq Pro subscription: cancel it in the store (see 03).
Suspension or closure of your account
We may only suspend or close your account on one of these grounds:
- a serious or repeated breach of the rules of use in section 09 or the content rules in section 08;
- being under 16 (see 02);
- where the law or a competent authority requires it.
If we do so, we will send you a notice stating the rule breached, the facts, the measure and the date it applies, and the channel for complaints (see 08). You will have 14 days to submit your arguments. If the suspension or closure is not due to a cause attributable to you, you are entitled to a refund of the proportional part of Nivoq Pro that you have paid for and cannot use: if you bought it on Google Play, we will refund it ourselves; if you bought it on iPhone, refunds are handled by Apple, so we will tell you how to request it from Apple, as Nivoq cannot refund it directly.
13Law and jurisdiction
- These terms are governed by Spanish law, without excluding the protection given to you by the mandatory rules of the European Union country where you live.
- If you are a consumer, you can bring a claim before the courts where you live.
- Before making a claim, write to us at soporte@nivoq.app: we will try to resolve it with you. You can also contact the consumer services where you live.
